Basic Rights Oregon Files Friend of the Court Brief

On December 21, in Federal Court, Basic Rights Oregon filed an Amicus Brief in Lemons v. Bradbury—the lawsuit filed by out of state anti-equality groups seeking to temporarily stop Oregon’s new Domestic Partnership law from going into effect on January 1, 2008.

Our brief puts information before the judge would not normally be raised by parties to the lawsuit. BRO’s job will be to inform the Court about the harms that will occur if the law does not go into effect on Jan 1.

A Recap of the Case

  • The American Defense League makes election-related law claims against the State of Oregon for failure to count supposedly valid signatures. (entity filing the law suit)
  • The Deputy Attorney General, the lawyer defending Secretary of State Bradbury, filed a response brief addressing those election law claims. (defendant against the lawsuit)
  • Basic Rights Oregon filed an Amicus brief, asking the Court to consider other issues, such as:
    • Same-sex domestic partners would be irreparably harmed if the domestic partnership law were enjoined
    • Committed same-sex partners should have the opportunity to have their relationship legally recognized and receive rights and responsibilities comparable to those afforded opposite-sex couples who legally marry.
    • An injunction at this late date will disrupt both the private and public sector that have taken steps and expended resources to comply with the new law.

    Time after time politicians make empty promises in an effort to get votes from “our” population. I wonder the effect econimically if every GLBT person in Oregon was to call in sick to work, refuse to vote, move out of the Country? I have had to cancel my cermony that was set to follow the paperwok completion at the courthouse. More than a financial cost, it has devestated me emotionally. This is how Oregon treats it’s tax paying citizens? I am ashames to live, work and raise my children here.
